1. Definitions
In these Terms and Conditions, the following terms have the meanings given below:
- "Service" means the private yacht tour services offered by tidewhiissa, including but not limited to the Coastal Daylight Voyage, Sunset Archipelago Circuit, and Overnight Open-Water Retreat.
- "User" / "Guest" means any individual who uses our website or engages us to provide a voyage.
- "We" / "Us" / "Our" refers to tidewhiissa, based at 28 Jalan Ampang, 50450 Kuala Lumpur, Malaysia.
- "Agreement" means these Terms and Conditions, along with any booking confirmation provided.
- "Content" means all text, images, and materials available on our website.
2. Acceptance of Terms
By using our website or engaging our services, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. You must be at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are arranging a voyage on behalf of others, you accept these terms on their behalf as well.
3. Service Description
tidewhiissa provides curated private yacht voyages along the coastline of Peninsular Malaysia. Services are operated subject to weather and sea conditions. All voyages are subject to availability and confirmed only upon receipt of a booking confirmation from us. We reserve the right to decline any booking at our discretion.
4. Booking and Confirmation
A voyage is considered provisionally reserved when you submit an enquiry and receive an initial response from us. A booking is only confirmed once we issue a written booking confirmation. Payment terms will be set out at the time of confirmation. You are responsible for ensuring that all guest information provided at booking is accurate.
5. User Responsibilities
As a guest, you agree to:
- Follow the instructions of the captain and crew at all times for safety purposes
- Disclose any medical conditions, mobility requirements, or allergies at the time of booking
- Treat crew members and other guests with respect
- Not bring aboard substances or materials prohibited under Malaysian law
- Not engage in conduct that endangers others or disrupts the voyage
We reserve the right to refuse boarding or to terminate a voyage early where a guest's conduct poses a safety risk or is significantly disruptive.
6. Weather and Rescheduling
Voyages may be rescheduled or cancelled by tidewhiissa where sea conditions or weather are assessed as unsafe for operation. Such decisions are made at the discretion of the captain. In the event of a tidewhiissa-initiated cancellation due to weather, guests will be offered an alternative date. We are not liable for costs incurred in connection with travel or accommodation arrangements made separately.
7. Payment Terms
Pricing is denominated in Malaysian Ringgit (MYR). Full payment terms will be outlined in the booking confirmation. We accept payment via methods communicated at the time of booking. All prices are inclusive of the service elements described on our Solutions page, unless otherwise stated.
8. Refund Policy
Cancellations made by guests more than 14 days before a voyage may be eligible for a partial or full refund, subject to the terms set out in the booking confirmation. Cancellations made within 14 days of the voyage date may not be eligible for refund. All refund requests are considered individually. tidewhiissa does not offer cash refunds; refunds where applicable are processed via the original payment method.
9. Intellectual Property
All content on this website, including text, images, and route descriptions, is the property of tidewhiissa. You may not reproduce, distribute, or use any content for commercial purposes without prior written consent. A limited, non-exclusive licence is granted to view and share content for personal, non-commercial reference only.
10. Disclaimers
Our services are provided in good faith and with reasonable care. However, we cannot guarantee specific outcomes from any voyage, including sea and weather conditions, wildlife sightings, or the precise execution of time-sensitive itinerary elements. The sea is inherently variable. We do not accept responsibility for circumstances beyond our control.
11. Limitation of Liability
To the maximum extent permitted by Malaysian law, tidewhiissa's liability in connection with any voyage or related service is limited to the amount paid for that voyage. We are not liable for indirect, incidental, or consequential loss, including loss of enjoyment or anticipated experience. This limitation does not apply to personal injury caused by our negligence.
12. Indemnification
You agree to indemnify tidewhiissa against any claims, damages, or expenses arising from your breach of these Terms, your misuse of our services, or your failure to disclose material information at the time of booking.
13. Termination
Either party may terminate a booking with appropriate notice. tidewhiissa may immediately terminate a voyage where a guest's conduct poses a safety or legal risk. The terms of these conditions that are relevant to post-voyage matters shall survive termination.
14. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of Malaysia. Any dispute arising from the use of our services or website shall be subject to the exclusive jurisdiction of the courts of Kuala Lumpur. We encourage guests to contact us directly in the first instance to resolve any concerns before pursuing formal dispute resolution.
15. Changes to Terms
We may update these Terms from time to time. Updated terms will be published at this URL with a revised date. Your continued use of our services after any update constitutes acceptance of the revised terms.
